FIELD APPLICATION

These conditions apply to the sale of goods or services on the website www.editions-clairobscur.com. Accordingly, the fact of ordering on www.editions-clairobscur.com implies full and unqualified acceptance of these Terms and Conditions.

PRICES

All our prices are quoted in euros all taxes included except customers participation in the costs of processing and mailing.

The EDITIONS CLAIR OBSCUR reserve the right to change its prices at any time but the products will be billed on the basis of the rates in effect at the time of order entry subject to availability on that date.

The products remain the property of CLAIR OBSCUR EDITIONS until full settlement of price.

The costs are based on the area of delivery:

-- Switzerland: 15.00 €
-- Europe: 15.00 €
-- Outside Europe: 15.00 €

PAYMENT

-- PAYPAL online payment directly from the site http://www.editions-clairobscur.com. The online payment system is secured by SSL.

-- By cheque: the cheque must be issued by a bank domiciled in France or Monaco. Cheques should be addressed to CLAIR OBSCUR EDITIONS.

AVAILABILITY

Our product offerings and prices are valid as long as they are visible on the site, within the limits of available stocks.
For products not stocked in our stores, our offers are subject to availability at our suppliers.

In the event of unavailability of a product after you have placed your order we will notify you by mail as soon as possible. Your order will be automatically cancelled and you will immediately be reimbursed if your bank account has been debited.

Important: The deadline for receipt of online payment is determined by our computer at 6 days.

When paying by check, in case of unavailability of all or part of the order, the refund will be made by CLAIR OBSCUR EDITIONS as a credit to the customer's bank account or by cheque at the latest within thirty days.
DELIVERIES - DELAYS

Total delivery delay for the products in stock:
(Take also into account the time of preparation of orders, ie the preparation of packaging)

-- Processing times and preparation in general vary from 1 to 2 days. They can be longer during public holidays, for example.

-- The transit times are 2 to 3 days for mainland France and Corsica.
For countries of the European Union, they range from 3 to 10 days depending on the country.

-- For shipments outside U.E. like Switzerland, clearance delays are added which are highly variable and that we do not master in any case.

Note: These deadlines are given as indicative by the Post Office, EDITIONS CLAIR OBSCUR are not to be held responsible for the consequences due to a shipping delay.

In the event of unavailability of one or more items of an order, the delivery time is based on the longest.

The EDITIONS CLAIR OBSCUR reserve the possibility to split the deliveries, the cost of processing and mailing will be charged only once.


DELIVERY PROBLEMS

You must notify the carrier and EDITIONS CLAIR OBSCUR any reservations on the product delivered (for ex. damaged package, already opened ...) within 3 days of receipt of the product.
The EDITIONS CLAIR OBSCUR are released from their obligation to deliver for all accidents or major force (total or partial strikes, floods, fires ...).

LINE OF PRODUCTS

We pledge to reimburse you or to exchange the defective products or products that do not correspond to your order. In this case we kindly refer to them in detail by e-mail: infos@editions-clairboscur.com and return the product. The EDITIONS CLAIR OBSCUR will, at your choice, exchange or refund the product. The request must be made within seven days of delivery. The products must be returned in the same shape in which they were delivered.
The shipping and returns will be reimbursed on the basis of the charged rate.

SATISFACTION OR YOUR MONEY BACK

In accordance with Article L.121-16 of the Consumer Code, the consumer has a period of 7 working days from the date of delivery of his order, to return any item which does not suit him and ask for exchange or refund without penalty, except for the cost of return.
This right of return will be accepted only for complete products, in their original packaging, in good condition and with a copy of the sales invoice. Incomplete returned articles, articles damaged or soiled by the client are not concerned.

RESPONSIBILITY

The products are conform to the French legislation and standards in France. The responsibility of EDITIONS CLAIR OBSCUR does not incur in the event of non-compliance with the laws of the country where the product is delivered (for example in cases of prohibition of a product…). It is your responsibility to check with local authorities the possibility of importing or use of products or services that you plan to order.
The pictures are communicated by way of illustration. We invite you to refer to the description of each product to know the precise characteristics.
The EDITIONS CLAIR OBSCUR are only responsible for the content of the pages they publish.
In case of manifest error between the characteristics of the product and its representation and / or conditions of the sales, EDITIONS CLAIR OBSCUR is not liable.

GUARANTEE

To qualify for the guarantee of the products you should keep the purchase invoice for the product.
  
APPLICABLE LAW - DISPUTES
  
This contract is subject to French law. In cases of dispute the court of Grenoble will be solely responsible.
